
What to Inspect in Park County Before the Ground Freezes
What should you inspect on a Park County property before the ground freezes? The order matters more than the list, because the freeze closes some checks for five months and improves one of them.
If you are under contract on a Park County property this fall, or about to be, and wondering which inspections cannot wait, this is written for you. It covers what the freeze takes away from a septic evaluator, a well contractor, and a home inspector, the order to run the checks in the weeks you have left, and the one thing worth doing this week before you write an offer.
Why does the freeze change what an inspection can tell you?
Frozen ground and snow cover hide the two systems that decide whether a rural property works: the septic drain field and the site drainage around the foundation. A septic evaluator cannot probe a frozen absorption field, an excavator cannot open a buried lid without breaking ground, and grading cannot be read under a foot of snow. Those checks either happen before the freeze or get deferred to spring with your money sitting in escrow.
The clock in Park County starts earlier than most buyers expect. NOAA's 1991 to 2020 climate normals give a 30 percent chance of first fall frost at Livingston Mission Field by September 7, and the first frost is the warning, not the freeze. The ground itself firms up over the following weeks, first on north slopes and shaded benches, then across the valley floor. Montana's own construction rules describe how deep the cold eventually reaches: outside certified building jurisdictions, the state's building permit FAQ cites Administrative Rule 24.301.142(9), which requires footings to sit at least three feet below finished grade for a single-story frame building and four feet for multistory or masonry. The rule sets a code minimum for footings, not a measurement of frost, and engineered designs and local soil can call for deeper. The useful reading for a buyer is that the state expects frost protection to begin three to four feet down. Components shallower than that, which includes most drain fields by design, any water line, and the frost-free hydrant by the barn, are the ones that can freeze in a hard winter without snow cover unless something protects them.
In my experience the practical deadline in the valley is late October for anything that requires digging or probing, and by mid-November the answer to "can we open the tank lid" is usually a shrug and a spring date. This post is the other half: fall is also when the inspection window narrows, and the two move against each other.
What should you check on the septic system before the ground freezes?
Order a septic evaluation by a licensed septic pumper or an inspector who evaluates existing systems (the county's site evaluator license covers soils and design work for new systems, so ask whether they inspect existing ones), with the tank opened and pumped, the outlet baffle checked, and the drain field walked and probed for surfacing effluent, before the ground hardens. Ask Park County Environmental Health for the original permit file at the same time. Nothing in the county's regulations requires any of this at sale, so if you do not order it, the county will not; whether it happens depends on you, your lender, and the contract.
Park County's Onsite Wastewater Treatment Regulations, revised May 7, 2012, make it unlawful to construct, alter, or repair an individual sewage treatment system without a permit from the Health Officer, and they require the county to inspect every new system before it is backfilled. The same regulations define a malfunctioning or failing system as one with effluent ponding or flowing on the ground surface, sewage backing into the building, failed structural components, or pollution of state waters. What they do not contain is any requirement that a system be evaluated when the property changes hands. Read together, that means the county has a file on every system permitted through it, and the buyer is the only person with a reason to open it. Two things the permit file tells you that the listing sheet will not. First, whether a system exists on paper at all. A house built before the county's permitting, or a system replaced by a handy previous owner, may have no file, and a system with no file is a system whose size, age, and location are somebody's memory. Second, the design capacity. The permit is written for a number of bedrooms. If the house has grown since, the field may be undersized for the load, and the county's roof-drain rule matters here too: the regulations say water from roof drains, surface runoff, gutters, and sump pumps shall not be discharged into a sewage treatment system. A downspout aimed at the drain field is a common finding on older Park County places and a cheap fix if you see it in October and an expensive one if you find it during a March thaw.
The evaluation itself follows the same logic a maintenance visit does. The EPA's septic care guidance says the average household system should be inspected at least every three years and pumped every three to five, and that the professional inspects for leaks and examines the scum and sludge layers, with pumping needed when scum is within six inches of the outlet, sludge within twelve, or the two together exceed a quarter of the liquid depth. Those intervals are a rule of thumb; the same guidance says the real frequency depends on household size, wastewater volume, solids, and tank size. Ask the evaluator to write down all three measurements. They tell you how the last owner used the system, and whether the pumping receipt the seller offers is recent or just the only one they could find.
The tradeoff is cost and access. A pump-and-evaluate on a buried tank means locating the lid, sometimes digging to it, and a pumper's truck getting up the driveway. On a property where the tank is under a lawn that has never been marked, the locating is half the job. What should a well check cover while the water table is low?
Run the flow test now, in the low-water end of the year, and pull the well log before you do. A well that delivers in late September after a dry summer has been stress-tested by the season; the same test in May, after runoff, tells you less. Pair the flow test with a certified-lab water sample and a look at the equipment that has to survive the winter.
Start with the record. The Montana Bureau of Mines and Geology runs the Ground Water Information Center, and MSU Extension's guide to finding a well log walks through the search: by owner name at the time of drilling, by street and city, by township, range, and section, by subdivision, or on the map. The log carries the depth, the water level, and the geologic material the driller went through. Compare the static water level on the log to the level your contractor measures during the flow test. A large drop between the two, on a well drilled decades ago, is the beginning of a conversation about aquifer decline that you want to have before closing, not after.
Then the test. The National Ground Water Association's annual well checkup guidance describes what a licensed or certified water well systems professional should do: a flow test to determine system output, a check of the water level before and during pumping where possible, pump motor performance including amp load, grounding, and line voltage, the pressure tank and pressure switch, a water test for coliform bacteria and nitrates, and a written report. The NGWA's testing guidance adds that owners should test at least annually for bacteria, nitrates, and any contaminants of local concern. For Park County, MSU Extension's county guidance for well owners names nitrate and bacteria as the yearly tests, lead if the plumbing predates the mid-1990s and especially where the water is corrosive, copper where the plumbing is copper, and arsenic and uranium as the most widespread contaminants posing human health risks in Montana groundwater.
Where to get the bottles is a local detail worth knowing. Park County's well water testing sheet says sample bottles can be picked up at the office at 414 E. Callender, that samples are dropped off on Mondays before noon, and that the testing is done by Bridger Analytical Labs in Bozeman; confirm the current days and hours with the office before you drive in. One caution on that route: MSU's Well Educated program states plainly on its testing page that it is not intended for real estate or legal purposes. For a purchase, have the sample collected and submitted by a professional with the lab's chain-of-custody, so the result can carry weight in a negotiation. The county kit is the right tool for the annual retest after you own the place.
The winter check is mechanical and it takes fifteen minutes. Confirm the well head is capped and sealed. Find the pitless adapter and confirm the water line leaves the casing below the frost depth described above. Look at the well house or pit: is there heat, is it working, is the insulation dry. Walk every frost-free hydrant and ask whether it drains back when shut. A hydrant that holds water in the riser will split the first hard night, and it will do it in a pasture you cannot reach with a truck in February.
What does the house itself need before snow covers it?
Read the roof, the grading, the chimney, and the heating fuel now, because snow hides the first two and the winter loads the last two. Radon is the exception: it is the one test that gets more accurate after the house is closed up, so it can be the item you carry past the freeze.
Snow load is the roof question in this county, and elevation moves the answer more than most buyers expect. Montana State University's Snow Loads for Structural Design in Montana, revised December 2004, lists 50-year ground snow loads by station. The Park County entries are below.

The state's own guidance has moved on from that document: the Department of Labor and Industry's snow load information page says ground snow loads for locations outside certified jurisdictions come from the ASCE 7 Hazard Tool or from the State Building Codes Bureau at (406) 841-2056. Treat the table as history, not as a design value for any roof built or repaired today. The reason the 2004 table is still worth reading is the shape of it. A bench above Wilsall carries half again the snow of the valley floor at the airport, and the upper Yellowstone toward Cooke City carries four times as much. When an inspector says a roof "looks fine," ask what it was built to carry and at what elevation. Sagging ridge lines, cracked trusses, and the tell-tale bow in a metal roof over an addition are all visible in October and invisible in January.
Grading and drainage are the second thing snow hides. Walk the foundation on a dry day and look for grade sloping toward the house, downspouts ending at the wall, window wells without covers, and the low spot where meltwater will pool in April. Frost heave is a function of water plus cold; the water is the part you can still fix in the fall. This is also where the county's septic rule about roof drains and sump pumps comes back around, because the cheapest drainage fix on many older places is redirecting a downspout, and the most expensive one is discovering in spring that the downspout has been feeding the drain field for a decade.
The chimney is a fall item because the first fire is a fall event. The Chimney Safety Institute of America's standard operating procedure for a Level 2 inspection says a Level 2 is recommended when the property is being sold, and that it requires going on the roof and inspecting the system within accessible attics, basements, and crawl spaces. A general home inspection looks at the firebox and the visible flue. It usually does not scan the liner. On a Park County house that has been heated with wood for thirty winters, the liner is the question.
Heating fuel is a paperwork item that becomes a winter problem. Many properties in the valley run on propane, and the tank in the yard may belong to the supplier rather than the seller. One national supplier's guide to buying a house with a propane tank is direct about the consequence, as a rule of the trade rather than a law: only the owning company can refill a leased tank. Ask for the lease or the bill of sale, photograph the data plate, and have the sale agreement list the fuel level at closing, because a half-full tank in October is several hundred dollars of propane that belongs to somebody.
Radon runs the other direction. The EPA's map of radon zones for Montana, hosted by the Montana DEQ, places Park County in Zone 1, the highest predicted indoor level, and notes that homes with elevated radon have been found in all three zones and all homes should be tested. The zone is a county-wide prediction; the only way to know a specific house is to test it. The DEQ's radon program page explains why timing matters: for a short-term test the house has to be kept closed except for normal entry and exit, as if it were the winter heating season, with the test starting no sooner than twelve hours after the house is closed up. The action level is 4 picocuries per liter, the DEQ recommends retesting at least every two years once a mitigation system is in, and it lists many short-term kits, lab fee included, at under $25. In a Paradise Valley house with the windows open in September, the number is soft. In the same house in December with the stove going, it is the number you will live with. That makes radon the natural candidate for a post-closing test with a mitigation credit negotiated up front, rather than a reason to hold the closing.
What about the land: ditches, irrigation, roads, and culverts?
Shut down and inspect anything that carries water across the property before it freezes, and get the winter road answer in writing. The irrigation system, the ditch, the culvert under the driveway, and the road itself are most likely to fail in the freeze and thaw season, and the seller is usually the person who knows their history best.
Irrigation first. If the property irrigates, the lines need blowing out and the headgate needs closing before the freeze, and the seller should show you how it is done, not tell you. The water right behind that headgate is a separate question with its own record at the DNRC, and a right that exists on paper but has not been exercised in years is a different asset than one that ran all summer. Ask when the water was last on, and please ask to see the ditch, not just the pivot.
Culverts and the driveway second. A culvert half full of silt in October is a culvert that freezes solid in December and floods the drive in March. Walk the length of the access with the seller and look at every crossing. On a private road, the question of who plows, what it costs, and what happened the last time nobody did belongs in the negotiation, and the answer arrives within weeks of a fall closing. That question gets its own post next month. The tradeoff on all of this is that it depends on the seller's cooperation and the seller's memory. A seller who has owned the place for two decades can walk it with you in an hour and tell you more than any inspector. A seller who bought it three years ago from a relocation and has never seen the ditch run will be as surprised as you are. The days-on-market history of the listing is a fair proxy for which one you have: a property that has been on and off the market for two years has usually been walked by other buyers who found something, and the seller knows what it was.
What if you cannot finish before the freeze?
Negotiate the deferred items into the contract rather than waiving them. The standard tools are an extended inspection deadline, an escrow holdback sized to the worst plausible repair, or a seller credit against a documented risk, and which one fits depends on how much of the ground is already frozen.
The inspection window starts with the people you hire, and that changed this year. The Montana Department of Labor and Industry's Home Inspector Program page states that effective January 1, 2026, all home inspectors in the state of Montana are required to be licensed, under House Bill 225, with inspectors who held an active registration on December 31, 2025 converted to the new license, and it links a licensee lookup. Under Montana Code Annotated 37-55-103, a license requires at least 40 hours of approved home inspection instruction, membership in a national home inspection association, and a minimum of $125,000 in errors and omissions coverage. Check the license, then ask the question the license does not answer: how many properties on wells and septic has this inspector done in Park County, and will they schedule the well contractor and the septic evaluator on the same morning so you drive out once.
When the calendar beats you, structure it. A septic evaluation that cannot be completed because the field is frozen is a known unknown with a bounded cost, and the bound is a replacement system permitted through the county under the regulations above. Your agent and the title company can hold a portion of the seller's proceeds in escrow against that number until a spring evaluation clears it, with the release terms written into the purchase agreement; have an attorney review that language before you sign it. A radon test is a smaller version of the same idea: close on schedule, test in the closed-house conditions of December, and carry a negotiated credit toward mitigation if the result lands above the action level.

Livingston's August 2026 closings, per Big Sky Country MLS data published by Bozeman Real Estate Group, ran to 27 sales at a median of $619,000, a median of 51 days to contract, sellers receiving an average of 94.8 percent of original list price, and 17 of the 27 closing under asking. Fifty-one days is enough time to run every check in the table above. It is not enough time to run them in the wrong order.
